Terms of Service

1. Acceptance of Terms

By accessing or using HarmonyEngine (“the Service”), operated by ZPQV, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

HarmonyEngine is a software analysis platform that ingests source code repositories and produces architecture analysis, executive summaries, system maps, and decision-support outputs for engineering and business leadership.

3. Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

4. Subscription and Billing

• Paid plans are billed on a monthly or annual basis as selected at checkout.
• All fees are non-refundable unless otherwise stated or required by law.
• We may change pricing with 30 days’ written notice. Existing subscriptions will not be affected until renewal.
• If payment fails, we may suspend access after a reasonable grace period.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse-engineer, decompile, or extract source code of the Service.
• Upload repositories you do not have the right to analyze.
• Interfere with or disrupt the Service or its infrastructure.
• Share account access with unauthorized third parties.

6. Intellectual Property

Your code remains yours. You retain all ownership and intellectual property rights to any source code you upload to HarmonyEngine. We claim no ownership over your repositories or the content within them.

The Service itself — including its design, features, documentation, and underlying technology — is owned by ZPQV and protected by applicable intellectual property laws.

7. Data Handling

Our handling of your data is governed by our Privacy Policy. Key commitments: we do not use your code to train models, we do not sell your data, and we encrypt all data in transit and at rest.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted access. We may perform maintenance with reasonable advance notice. We are not liable for downtime beyond our control.

9. Limitation of Liability

To the maximum extent permitted by law, HarmonyEngine and ZPQV shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

You may cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. You may request deletion of your data per our Privacy Policy.

11. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notice at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ZPQV is incorporated, without regard to conflict of law principles.
